Flat Booking Cancellation

I booked a Builder flat 3 BHK in Ghaziabad, Behrampur near Vijaynagar.
I have filed a cancellation request before 7-8 month but I didn't get money refund.
BUilder is giving me excuses if someone booked the flat them I will get the refund.

Please suggest me can I take any legal action against that builder.

A.Hello,
If you have an agreement which mentions the refund policy for cancellation, then you can issue a legal notice to him to fulfill his obligations.

I don't have an agreement, I have just paid token money 10 % of the amount via online payment.

A.Both person must be ready to file cancellation deed then it will be possible . What are the reason for cancellation

Hi, Rameshwar Thanks for your response.
I don't have an agreement, I have just paid token money 10 % of the amount via online payment.
Cancellation reason is family didn't like the location.
