Stay order for locker-freeze locker

I wanted to know what is the procedure for stay order on sbi locker. This is because after my mom expired Mamaji got involved in opening a locker n kept property papers , father will as well as my Jewellary without my consent. He took the custody's for these along with my brother. Locker is jointly operated ( brother n Mamaji) n when I asked Mamaji that I want to read my father’s will n I need my jewellery he denied also he is holding bank locker key. Please share the steps how can I go about it. And bank is saying we cannot do anything in this until you get stay order

Dear Sir,

You have a very strong case because:

Mamaji is not a legal heir

Locker contents belong to legal heirs (not locker holders alone)
Denial of access = civil wrong + possible criminal breach of trust

You can also consider:

Police complaint (for pressure)

But primary remedy is civil injunction

Temporary Injunction Order under

Order 39 Rules 1 & 2 CPC

Along with a civil suit for partition / declaration / injunction

This will:

Restrain your brother & Mamaji from operating the locker

Prevent removal of jewellery/documents

Direct State Bank of India to freeze or not permit operation without court permission

Dear Client,

If your relatives are operating a locker in State Bank of India and have taken property papers, your father’s will, and your jewellery without your consent, you can approach the Civil Court to seek a stay or injunction order on the locker.

You should file a civil suit for injunction and protection of property along with an interim application requesting the court to restrain the joint holders (your brother and Mamaji) from operating the locker until the dispute is decided.

After filing the suit, the court may pass an interim stay order directing the bank not to allow any operation of the locker. Once you obtain this order, submit a certified copy to the bank, and they will place a hold on the locker operations until further directions from the court.
