First, merely stating in an email that you are a co-applicant does not automatically make you legally liable. Liability as a co-applicant arises only if you have actually signed the loan agreement or any related documents. The primary evidence is the loan agreement, KYC records, and bank documentation. If your name does not appear in the official loan records or agreement, then your earlier statement alone cannot create legal liability.
At this stage, your priority should be to verify the actual loan documents. You should send a formal written request to ICICI Bank asking for certified copies of the complete loan file, including the loan agreement, application form, KYC documents, repayment schedule, and any insurance policy linked to the loan. Clearly state that you are seeking confirmation of whether you are a co-applicant or not. Keep this communication in writing for record purposes.
Secondly, do not make any admission going forward. Instead, clarify your position by stating that your earlier communication was based on assumption or incomplete information and that you are seeking verification from records. This helps protect you from any unintended admission being used against you later.
Thirdly, check whether there is any loan insurance attached. Many personal loans are covered by credit life insurance, which can settle the outstanding amount in case of the borrower’s death. If such a policy exists, you can submit a claim along with the death certificate and required documents.
If the bank continues recovery efforts against you without proof of your liability, you can escalate the matter through the bank’s grievance mechanism and, if necessary, approach the Reserve Bank of India for redressal. You may also consider issuing a legal notice seeking clarification and restraining coercive recovery.
As a precaution, avoid making any payments or signing any documents until your status is clearly established. Also, preserve all emails and communications as evidence.
