Can bank classify all loans as NPA borrower-wise and initiate SARFAESI
have multiple facilities with a bank (credit cards, home loan, and car loan). My credit card account has become NPA due to non-payment. However, my home loan and car loan EMIs are fully regular with no overdue. The bank is now stating that as per RBI norms, asset classification is borrower-wise and not facility-wise, and therefore: All my loan accounts (including home loan) are being treated as NPA They are also threatening action under SARFAESI on my house I understand that under SARFAESI Act 2002, action can be taken only when the specific secured loan account is classified as NPA. My questions are: Can the bank legally classify a regular home loan as NPA solely based on default in a credit card (borrower-wise NPA)? Can they initiate SARFAESI proceedings on a home loan account where no EMI default has occurred? Does the RBI guideline on borrower-wise classification override the requirement of account-level default? Are there any judgments applicable to individual retail borrowers (not corporate/IBC cases) supporting such action? I want to understand my legal position and whether this action is valid or challengeable.
