If the old meter remained installed because the electricity distribution company never replaced it with a smart prepaid meter, then the penalty may not be legally sustainable merely because the old meter was still in use. The company must show that you deliberately refused installation, obstructed the officials, tampered with the meter, or committed unauthorized use of electricity. If no notice was given, no installation date was fixed, or your family never refused replacement, then keeping the old meter alone does not automatically make you liable.
You should immediately give a written representation to the local electricity office asking for a copy of the inspection report, the basis of the penalty, and proof of your alleged refusal. You should also seek a copy of any complaint made to the police station. If the department does not withdraw the penalty, you can challenge it before the Consumer Grievance Redressal Forum and the Electricity Ombudsman, while keeping records such as electricity bills, payment receipts, and photographs of the old meter to show that you never obstructed the replacement process.
