Epfo and Employment overlap for 13days

Hi, I have resigned from my first company on 8.10.20 by submitting resignation on medical ground and take immediate resignation by paying notice period recovery and joined next company on 12.10.2020. However in the relieving letter as well as in epfo portal 1st employer marked my Lwd as 25.10.2020 which created an overlap for 13days with my 2nd company also update ncp days as 0. However I had received last salary from my 1st emp on 1.10.2020, after that no salary was credited. Now I’m in BGC process of my 3rd company. 1st com denied to change the date. How to overcome this issue?

Dear Client,
A minor overlap in EPFO records due to incorrect last working date is a common issue and does not automatically imply dual employment, especially since you have proof of resignation, no salary post 1.10.2020, and payment of notice period. You should provide resignation acceptance, notice buyout proof, and bank statements to explain the discrepancy during BGC, and may also submit a joint declaration to EPFO for correction.
If the first employer refuses to correct the date, you may issue a legal notice seeking rectification of records and proper updating of your last working date. It is advisable to consult a local lawyer for proper drafting and further action.
