A.
Dear Sir/Madam,
Validity period of POA
A POA does not have a fixed validity period unless specifically mentioned.
For property matters, it is advisable to mention validity or purpose clearly to avoid disputes.
Whether notarized POA is sufficient for sale of property
No — Notarized POA alone is NOT sufficient for sale of immovable property.
As per law laid down in
Suraj Lamp & Industries Pvt. Ltd. v. State of Haryana
Property cannot be legally transferred through GPA/SPA alone
A registered Sale Deed is compulsory
For executing sale via POA:
POA must be properly stamped and REGISTERED
You can execute POA in Bangalore even if property is in Tamil Nadu
However:
Ensure proper stamp duty (as per TN law if it relates to TN property)
For registration, Sub-Registrar may insist on adjudication of stamp duty
4. Whether principal can still sell after giving POA
✔️ Yes, absolutely.
POA does not transfer ownership
Principal retains full rights unless:
POA is irrevocable coupled with interest
So:
Principal can sell directly
Principal can revoke POA anytime (unless irrevocable)
Registration of POA in Bangalore for TN property
Yes, it can be registered in Bangalore
But practical steps:
POA executed & registered in Karnataka
Then:
May require adjudication / validation in Tamil Nadu before use
Especially for sale transactions
In many TN Sub-Registrar offices:
They insist POA be:
either registered in TN
or authenticated/adjudicated in TN
