Relieving and Notice period

Dear Sir/madam, I have will fully resigned. But employer is giving me notice of only 15 days against 60 days in my appointment letter. Now they are threatening me they will issue termination letter on the grounds of non performance if i don't leave. Can i file a legal notice if my jurisdiction says Mumbai but im currently working in Bangalore.

Dear Sir,

You can issue a legal notice for:

Enforcing 60 days notice clause
Objecting to:
Forced early exit
Threat of false termination
Seeking:
Proper relieving letter
Experience certificate
Full & final settlement

Even if your contract says Mumbai jurisdiction, you still have options:

You CAN proceed from Bangalore because:
You are currently working in Bangalore
Cause of action arises where you work

Under civil law principles:

You may file
Cause of action arises (Bangalore)

If your appointment letter provides for a 60 day notice period, the employer cannot unilaterally reduce it to 15 days unless such a provision exists in the contract or policy. Threatening termination on grounds of non performance to compel early exit may be challenged if it is not based on actual performance issues.

You may issue a legal notice asserting your contractual rights. As regards jurisdiction, if the agreement specifies Mumbai, you may have to initiate proceedings there. However, since you are currently working in Bangalore, certain aspects may also give rise to cause of action there depending on facts.

It is advisable to review your appointment letter and consult a local lawyer to determine the appropriate course of action.
