As per guidelines of the Department of Personnel and Training, creamy layer status is not determined only on the basis of income when the parent is a government employee. In such cases, the category of the post held by the parent is the main factor.
Since your father is a Group C government employee, you are generally considered to fall under the Non-Creamy Layer category, irrespective of the income level. The Rs.8 lakh income limit is mainly applicable to those earning from business, private jobs, or other non-salaried sources, not strictly to lower-rank government servants.
Therefore, the rejection by the Tahsildar appears to be due to incorrect application of the income rule alone. You can reapply or file an appeal by submitting proof of your father’s Group C status, and clarify that as per government rules, you are eligible for OBC NCL.
