Dear client,
You are in a situation where the law clearly protects both you and your child, even if you are not ready for divorce right now.
You can file a petition for judicial separation under the Hindu Marriage Act, 1955 (Section 10). Judicial separation allows you to live separately without dissolving the marriage, while still asserting your legal rights. The grounds can include cruelty, harassment, and denial of basic support, which are evident from your husband’s conduct—especially stopping expenses and imposing conditions for child care.
Along with judicial separation, you should immediately seek maintenance and child support. Your husband is legally bound to maintain both you and your 7-month-old baby.
You can also file a case under the Protection of Women from Domestic Violence Act, 2005, where you can seek:
Monthly maintenance
Residence rights (right to safe accommodation)
Protection orders against harassment
Child custody and expenses
Regarding your child, at this age (7 months), custody will normally remain with the mother, and the father will be directed to pay child maintenance. His demand that you return and pay for maid/cook is not legally valid—it is his duty to support the child regardless of where you live.
Since you have already left due to safety concerns, you are legally justified in staying at your mother’s home. His refusal to provide expenses can itself be treated as economic abuse and cruelty.
