Unhappy with dlsa lawyer

I complaint against a CA for non payment of wages in dlsa. I was shouted and unreasonably penalized and forcefully terminated giving 20 days of time. Because of these issues I resigned on the next day in WhatsApp, so it hurted his ego. Only because of it he imposes an unlawful condition of giving resignation being present in his office. Even after I went to his office and spoken with his another business partner and sending resignation by post on the advice of the dlsa advocate he doesn't gave my salary and on the top of it he demands an apology letter from me for resigning on WhatsApp. The advocate of dlsa also takes his side and said it is must to resign with written resignation letter. I am not happy with the advocate as I know by labour laws written resignation is not mandatory. And also I don't have any document given from that office as a proof of that job. Please tell me how can I get my justice?

Dear Client,

Your employer’s conduct is legally unjustified—resignation through WhatsApp or post is valid in the absence of any written contract mandating a specific format, and salary already earned cannot be withheld on arbitrary conditions like submitting an apology or resigning physically in office.

Such withholding clearly violates the Payment of Wages Act, 1936. Even without an appointment letter, you can prove employment through WhatsApp chats, postal records, and witness interactions, and the stance taken by the District Legal Services Authority advocate is not binding on you. The practical course is to send a formal legal notice demanding payment within a fixed time and, if ignored, file a complaint before the Labour Commissioner or initiate proceedings under the Industrial Disputes Act, 1947 (if applicable) or a civil recovery case, while firmly refusing to comply with any unlawful demands.
