Not providing NOC

If the dealer is not providing the NOC even after 1.5 years despite repeated assurances, it clearly amounts to deficiency in service and unfair trade practice, especially since the NOC is essential for transfer of ownership and lawful use of the vehicle. Legally, once you have purchased the vehicle, it is the dealer’s responsibility to ensure that all necessary documents, including the NOC (particularly if the vehicle was registered in another state or under finance), are provided within a reasonable time. You should first send a legal notice to the dealer demanding issuance of the NOC within a fixed time frame , mentioning all previous communications and the prolonged delay. If the dealer still fails to comply, you can file a complaint before the Consumer Commission claiming not only direction for issuance of the NOC but also compensation for mental harassment, delay, and any financial loss suffered. Additionally, you may approach the RTO concerned to report the issue, as they can take note of irregularities in transfer and may guide or intervene administratively. Keep all documents safely, including purchase invoice, payment proof, and communication records, as evidence. Continuous delay of this nature can also raise suspicion of irregularities in the vehicle’s documentation, so timely legal action is important.

Since it has already been 1.5 years, the dealer is clearly delaying your work, so you should stop waiting and take action: send a formal legal notice demanding the NOC within a fixed time, contact the RTO in Delhi to check the vehicle status and report the issue, and if needed file a police complaint or a case in consumer court for deficiency of service; make sure you keep all documents like payment proof, agreement, and messages, because at this stage only legal or official pressure is likely to get your NOC done.
