Whether Concealment of Parallel Relationships and False Assurance
If a man enters into a relationship with a woman while simultaneously maintaining relationships with other women, and falsely assures her that she is his only partner—thereby inducing her to engage in sexual intercourse under the mistaken belief of exclusivity—does his concealment of other relationships constitute 'deceitful means' under Section 69 of the Bharatiya Nyaya Sanhita, 2023? There is no precedent of the High Courts or the Supreme Court of India on this issue. The legislative enactment also does not specifically state that “deceitful means” includes concealment or suppression of material facts, or false assurance of exclusivity, in a case such as the present one, where there were no discussions regarding marriage and no promise of future marriage between the parties.
