Cancellation of Joint Venture Development agreement
I entered into a Joint Venture Development Agreement (JDA) on 11 December 2023 in Howrah. The property falls under a special zone of Kolkata Metropolitan Development Authority as it is near Kona Expressway. The builder was allegedly unaware of this KMDA jurisdiction, and we were not informed that KMDA approval would be required before entering into the agreement. It has now been nearly two years, yet there is still no plan approval and no construction has begun because the matter is stuck in the KMDA approval process. We are currently living on rent because the builder demolished the house in 2024. My mother, who is 66 years old, is the co-owner of the property. The builder has also been paying rent late. During an argument, he threatened to leave the land as it is, not carry out any construction, and claimed that no law, no Supreme Court, and no landlord could win against builders. Additionally, we did not receive any advance payment or financial consideration from the builder at the time of signing the agreement. The agreement states that if any dispute arises, it must first be negotiated within 30 days, and if unresolved, both parties shall appoint an arbitrator to settle the matter. The period for handing over the flats is 30 months from the date of the agreement, which ends on 11 December 2026. We now wish to cancel the agreement and recover our land after this deadline. Please suggest any immediate ways or tactics to cancel the agreement easily.
