Domestic Violence

Physical assault by wife

Married 3 months ago. Govt employee Wife non working.Wife has anger issues and dominating in nature Ahe assaulted me on 11th,16th and 22nd April with punches and nails while trying to snatch my mobile.I had mlc,photos,audio recordings of incident.I don't know how to proceed: Police intimation or complaint, mediation? If done and she starts living with me,it will assumed condonation? Anticipatory bail for counter cases?

Dear Sir,

You should at minimum document the incidents officially with the police, consider mediation only if safe, and take legal advice on anticipatory bail as a precaution. Do not ignore repeated violence—early legal steps will protect you both in criminal and matrimonial proceedings.

You should first create a formal record by lodging a police intimation or NC complaint rather than rushing into an FIR, while also exploring structured mediation through a court or counselling cell if you still want reconciliation.

However, do not resume cohabitation casually, because living together again without recording your objections may be treated as condonation of cruelty later. The assaults can attract provisions like Section 351 of the Bharatiya Nyaya Sanhita, 2023, and in practice there is also a real risk of counter-cases such as Section 85 of the Bharatiya Nyaya Sanhita, 2023, so it is prudent to simultaneously consult a lawyer for an anticipatory bail strategy and avoid private confrontations.
