Subject: Exhaustive Formal Petition: Recovery of Wages, Complaint of Systemic Statutory Fraud (P-Tax), and Demand for Multi-Party Damages Due to Gross Administrative Negligence Note to Authorities: I, Pradip Nath, am not a practicing advocate; however, having previously served under a Hon’ble Judge of the High Court, I have drafted this petition with a focus on statutory compliance and the fundamental right to fair wages. I request that any minor procedural technicalities be overlooked in favor of the gravity of the systemic fraud reported herein. DISTRIBUTION MEMO / URGENT ACTION REQUIRED To CLC (Central) & State Labour Commissioner: For immediate intervention regarding willful wage theft and the blatant disregard for the Labour Commission's authority by SB Infowaves management. To RLO Bidhannagar & DLC (EL&MW): This serves as a formal escalation of my previous ignored petition dated Nov 15, 2025. As per the West Bengal Right to Public Services Act, I demand an explanation for the 150+ day delay in processing my grievance. You were supposed to send the legal notice demanding the company to answer and provide the payslips. To Directorate of Commercial Taxes (P-Tax): For a forensic audit of fraudulent Professional Tax deductions. I demand a compulsion order for the company to produce all my payslips from Nov 2023 to Jan 2025 to verify illegal deductions made below the ₹10,000 gross threshold. To EPFO Regional Office: To investigate why PF/ESI were listed as "N/A" on payslips while deductions were still being taken from my gross pay—indicating potential embezzlement of statutory funds. To DLSA: For the urgent appointment of pro bono legal counsel to represent a gig worker facing severe financial hardship and debt due to corporate malpractice. I. FORMAL DECLARATION OF GRIEVANCE I, Pradip Nath, a resident of Sukanta Pally, Boral, Kolkata, submiting this petition against SB Infowaves (formerly VAP Technology). Beyond the recovery of my rightful dues of ₹3,500—which constitutes my entire monthly rent and electricity cost—this petition exposes a pattern of corporate wage theft, rebranding for the purpose of evading liability, and criminal financial fraud. II. CHRONOLOGY OF EVENTS & BREACH OF TRUST Illegal Termination & Wage Theft (Jan 7, 2025): I was terminated based on a client miscommunication. Despite the Payment of Wages Act mandating payment for all days worked, the company withheld 7 days of wages citing internal "policy," which cannot supersede state law. Ignored Demands & Verbal Abuse (Nov 14, 2025): My formal requests were ignored. Upon follow-up, I was met with verbal abuse by the Manager, who explicitly denied my legal entitlement. Administrative Negligence (Nov 15, 2025 – Present): My complaint to the Local Labour Commissioner, Kolkata, has been ignored for over 150 days. This inaction has emboldened the employer to continue their illegal practices. Tried to contact the CEO via her Linkedin, she is highly active there, still she ignored my message, recently I confronted her in one of her posts where she was boasting about her 200+ employee journey of 15 years. Still she didn't take action to clear my wages or contact me. A company making Crores can't pay 3500 rupees wages due ? Final Confrontation & Mockery (April 21, 2026): During a final attempt at a peaceful settlement, the Manager stated: "Bring the Labour Commission here," while mocking my legal rights and said "We should not have paid you the previous month salary as well"(December 2024 Salary). This documented audacity proves the company believes they are above the law. III. REPORT OF CRIMINAL FINANCIAL FRAUD & DEMANDED ACTIONS I formally demand the following actions to be initiated within 48 hours: Forensic Audit: Conduct an audit of SB Infowaves and VAP Technology regarding P-Tax deductions. I suspect a fixed P-Tax was charged even when gross salaries fell below the ₹10,000 statutory limit. Asset Seizure: Should fraud be confirmed, I request the immediate sealing of company funds to ensure the recovery of dues for all affected employees (past and present). Statutory Verification: Investigate the "N/A" status of UAN/ESI numbers on payslips where deductions were still captured. Corporate Identity Probe: Investigate the rebranding from VAP Technology to SB Infowaves to ensure this was not a "Phoenixing" tactic used to escape legal liabilities and creditors. IV. ITEMIZED CLAIM FOR DAMAGES (Total: ₹1,08,951 + Interest) Unpaid Wages (Jan 1–7, 2025): ₹3,500 Statutory Penalty (10x Salary for Default): ₹35,000 Mental Harassment & Financial Agony: ₹50,000 Admin/Documentation/Travel Costs: ₹10,451 Interest: 12% per annum from Feb 10, 2025, until the date of realization. V. FINAL NOTICE The company’s management has openly challenged the authority of the Labour Commission. I will persist relentlessly through all available legal and public channels until SB Infowaves is held accountable and the negligent local authorities are investigated. I urge the Commission to act before the company can destroy digital evidence or further manipulate their payroll records.
