Dear client,
Being a minor aged 15 years and presently residing away from the custodial parent, if the child is facing mental harassment, emotional abuse, neglect, alcoholism within the household environment, or circumstances affecting mental health and well-being, remedies are available under Indian law. A complaint may be made before the local police station, the Child Welfare Committee, or through CHILDLINE India Foundation by dialling 1098, seeking intervention, counselling, protection, and assessment of the living conditions of the child. Under the Juvenile Justice (Care and Protection of Children) Act, 2015, a child subjected to neglect, emotional cruelty, unsafe guardianship conditions, or circumstances detrimental to welfare may be treated as a child in need of care and protection. The custodial parent may also be informed formally regarding the present living circumstances and requested to make alternative arrangements in the best interest of the child. If required, an application regarding custody, visitation, guardianship, or welfare of the child may also be moved before the appropriate Family Court having jurisdiction.Being a minor aged 15 years and presently residing away from the custodial parent, if the child is facing mental harassment, emotional abuse, neglect, alcoholism within the household environment, or circumstances affecting mental health and well-being, remedies are available under Indian law.
