If both your parents are serving as Group ‘C’ Government employees and belong to a recognised OBC category falling under 2A in Karnataka, then merely because the annual family income exceeds Rs 8 lakhs does not automatically exclude you from obtaining an OBC Non-Creamy Layer certificate. As per the principles governing creamy layer determination under the OBC reservation framework, the salary income of parents who are Government servants is not assessed solely on the basis of the Rs 8 lakh income criterion; rather, the status and category of service held by the parents are also relevant considerations. Generally, children of parents who are both holding Group ‘C’ or Group ‘D’ posts are treated as falling within the Non-Creamy Layer category, unless the parents were promoted from lower posts to higher Group ‘A’ or equivalent categories under circumstances attracting creamy layer exclusion. Therefore, if your parents are regular Group ‘C’ primary teachers and do not fall within the creamy layer exclusion categories prescribed by the Central Government or the State of Karnataka, you may still be eligible for issuance of an NCL certificate despite the income exceeding Rs 8 lakhs. However, the final determination depends upon the exact service classification, recruiting authority, promotion history, and the purpose for which the certificate is sought, namely State reservation or Central Government reservation. It is advisable to verify the latest Karnataka State Backward Classes guidelines and furnish service certificates showing the Group ‘C’ status of both parents while applying for the certificate.
