Builder Delay in Possession OC CC and Society Formation Since 2015
I am seeking legal advice regarding a residential project in Pune, Maharashtra. The project started around 2012 and 98% ready for use in 2016. One particular building/wing (7th wing) has several legal and approval-related issues, and I want guidance before purchasing a resale flat there. As per my understanding, the original building construction was substantially completed around 2016. However, the builder allegedly constructed an additional 11th floor apartment(s) beyond the sanctioned/approved plan from Pune Metropolitan Region Development Authority (PMRDA) and sold those flats to certain investors. Internal work on that extra floor is still incomplete even today. Despite this, the builder executed only a “Permission to Enter” agreement with flat purchasers instead of issuing proper possession letters. Many residents started occupying and residing in the building without Occupancy Certificate (OC). Till date, the following are reportedly not available for this wing/building: Occupancy Certificate (OC) Completion Certificate (CC) Proper possession letter/documentation Formation and handover of cooperative housing society/apartment association for this wing The builder has also not formed the society for this 7th building/wing, whereas societies for the other 6 wings in the same project have at least been formed individually wing-wise. I am now considering purchasing a resale flat in this particular building/wing and would like legal advice on the following: Is it legally safe to purchase a resale flat in a building without OC/CC and without society formation? What risks can arise in future regarding legality, demolition notices, regularization, utilities, bank loans, resale, or redevelopment? Can the unauthorized additional 11th floor create legal issues for the entire building or existing flat owners? What documents should I verify before proceeding? Would you advise against purchasing such a property in the current situation? What remedies do existing flat owners have against the builder for delay in OC, society formation, and possession-related irregularities? Please advise from a Maharashtra property law/RERA perspective.
