GRAND FATHERS PROPERTY DOCUMENTS AND PROPERTY TAX

Dear Sir,

If your uncle continues refusing to cooperate, you may send a legal notice demanding:

Disclosure of original property documents,
Details of mutation proceedings,
Partition of the property,
Sharing of possession and records.

Thereafter, if no settlement is possible, you can file:

A suit for partition and separate possession,
A declaration suit challenging fraudulent mutation,
An injunction restraining him from selling or creating third-party rights over the property.

Dear Client,
If the property originally belonged to your grandfather and mutation/property tax was changed solely in your uncle’s name without knowledge of other legal heirs, such mutation does not automatically make him absolute owner. Mutation and tax entries are mainly for revenue purposes and do not by themselves decide title.
You can independently obtain certified copies of title documents, mutation records, tax records, and revenue entries from the Sub Registrar Office, MRO, and municipal authorities even if your uncle refuses to cooperate. You may also seek partition and declaration of your legal share if the property is ancestral or if your father had inheritance rights.
If fraud or suppression was involved in mutation, the same can be challenged before the competent revenue authority or civil court. Please consult a local advocate for proper document retrieval and legal proceedings.
