In Assam, the “two-child policy” mainly affects eligibility for government employment, service-related benefits and participation in certain public offices. In the case of an existing Government employee, having a third child does not ordinarily result in automatic termination from service merely on that ground. However, after the amendments introduced by the Government of Assam and the incorporation of the two-child norm into service-related policies and conduct rules, violation of the said norm may expose an employee to departmental scrutiny or disciplinary consequences depending upon the department, cadre and the specific service rules applicable to the employee concerned.
Accordingly, while your service may not automatically come to an end upon the birth of a third child, you may face certain practical and service-related difficulties such as departmental proceedings, adverse service remarks, complications in promotion or career advancement, denial of certain incentives or benefits linked to the policy and possible ineligibility for some future appointments or public positions. The exact consequences may vary from department to department and may also depend upon the date of birth of the third child and whether the amended rules specifically apply to your service cadre.
It is also relevant that the Government of Assam has provided certain exemptions or relaxations for specific communities/categories in relation to the two-child norm. Therefore, before taking any decision, it would be advisable to verify the exact service rules applicable to your department and ascertain whether any exemption or relaxation is available in your case.
In view of the above, it would be prudent to obtain a copy of the latest applicable Assam Government service rules or departmental circulars and, if necessary, seek clarification from your department administration or through an RTI application so that you may clearly understand the legal and service consequences before proceeding further.
