For OBC Non-Creamy Layer (NCL) status, the determination is not based solely on the annual income figure. The nature of the parent's employment is also an important factor.
In your case, your father is a government primary school assistant teacher. For government employees, eligibility for OBC-NCL is often assessed with reference to the parent's service status (Group/Class of post and promotion history), and not merely by whether the salary exceeds Rs. 8 lakh per year.
Further, income from salary of a government employee is treated differently from income from business, profession, or other sources for NCL purposes. Therefore, the fact that your father's annual salary is around Rs. 9.5 lakh does not automatically mean that you fall in the Creamy Layer.
To determine your eligibility, it would be necessary to know:
1. Whether your father belongs to an OBC category recognized by the relevant authority;
2. His service classification (Group A, Group B, Group C, or equivalent, or the corresponding erstwhile Class I/Class II classification);
3. Whether he was directly recruited or promoted to his present post.
A primary school assistant teacher is commonly not a Group A officer, and many children of such employees remain eligible for OBC-NCL, but the final determination depends on the specific service details and the applicable rules.
You should apply for an OBC-NCL certificate through the competent authority in Jharkhand and provide your father's service particulars. The authority will determine eligibility based on the applicable Central or State OBC-NCL criteria.
