Alienation of public trust property

As a general rule, immovable trust properties entrusted to the trustee are, by their very nature,[5] inalienable.[6] A trustee including a Shebait can alienate trust property only in exceptional cases,such as legal necessity,for the benefit or preservation of the property etc.

Dear Client,

Yes. As a general rule, trust property, particularly immovable property dedicated to a trust, is considered inalienable, and a trustee cannot freely transfer or dispose of it.

Alienation is permissible only in exceptional circumstances, such as legal necessity, benefit of the trust, preservation of the property, discharge of indispensable obligations, or other acts demonstrably in the interests of the trust.

Any transfer made without such necessity or benefit may be challenged and set aside by a competent court.
