Destruction of forged POA
Tell me a thing in the exact case the settlor creates a charitable trust and gives Rs 100 to it. Another person B creates a forged and fraud POA and on behalf of the settlor transfer the movable to the trust. He then burns the POA leaving no evidence. The trustees do not know about it and believe it to be a settlors intent. Years after B confesses fraud and forgery and notes this to trustees and settlor. The parties mutually decide to rescind the agreement and go to court. Will the agreement be rescind as the forged POA was extinguished? Please note amidst the years the property was not used in any public works although the transfer agreement mandates it.
