Eligibility for an EWS certificate is determined based on your status on the relevant cut off date and the applicable Government guidelines. If, on that date, your family owned a residential plot exceeding the prescribed limit, merely subdividing and selling a portion later may not automatically make you eligible.
If, however, the subdivision and sale are completed before the relevant cut off date and you otherwise satisfy all EWS criteria, including income and asset limits, you may become eligible. The competent authority will verify the actual ownership and eligibility at the time of issuing the certificate.
You may consult a local lawyer or advocate or the concerned revenue authority to verify your eligibility under the applicable Central or State EWS rules.
