Simply being unable to repay payday loans does not give collection agents the legal right to assault, threaten, or publicly humiliate you. If a collection agent beats you, intimidates you, unlawfully enters your home, or harasses you, that conduct is illegal and should be reported to the police immediately. The most serious legal consequences of defaulting on payday loans are generally civil in nature, such as repeated collection efforts, damage to your credit history (where applicable), additional interest or penalties as permitted by law, and the lender filing a civil case to recover the outstanding amount.

In some cases, a court may order repayment if the lender succeeds in legal proceedings, but merely being unable to pay a genuine debt is not, by itself, a criminal offence. If you are facing financial hardship because you are caring for your 71-year-old mother, it is advisable to contact each lender, explain your circumstances, and request a repayment plan, reduced instalments, or other hardship assistance. Keep records of all communications and do not ignore legal notices. It is also advisable to consult an advocate who can assess your specific circumstances, advise you on your legal rights and obligations, communicate with the lenders on your behalf if necessary, and help protect you from any unlawful recovery practices.
