Dear Client,
If you are presently unemployed due to genuine health issues, your defence should focus on proving that there has been a substantial change in your financial and medical circumstances since you were working in the Gulf. Do not rely only on oral statements. Immediately obtain a medical certificate from your treating doctor describing your diagnosis, treatment, and any advice regarding rest or inability to work.
Collect and preserve all supporting documents, including scan reports, prescriptions, medical bills, passport entries, visa cancellation or expiry (if applicable), employment termination or resignation documents, and bank statements showing that your salary has stopped. Without delay, engage a lawyer to file the appropriate application to set aside the ex parte order (if legally maintainable) or seek modification/reduction of the maintenance amount based on your current inability to earn, along with an application for stay of the order or its execution, if permissible.
Since the existing order remains enforceable until modified or stayed, avoid ignoring it and place all material facts before the Court at the earliest to demonstrate that your unemployment and financial hardship are genuine and not deliberate.
