Dear Sir,
Procedure before the Court
Obtain a Non-Availability Certificate (NAC) from the Registrar of Births and Deaths stating that no death entry exists in the register for your grandmother.
File a petition under Section 13(3) before the JMFC seeking permission for delayed registration of death.
Along with the petition, file:
Affidavit of the applicant.
Non-Availability Certificate.
Genealogical tree.
Identity proof of the applicant.
Any available material indicating the death.
Since you state there is no ration card, voter ID or other documentary proof, produce oral evidence. The Magistrate is empowered to verify the correctness of the death through evidence and is not confined only to documentary proof.
