Although the institute's admission terms contain a "no refund under any circumstances" clause, such a condition does not automatically bar a consumer from seeking relief if its enforcement is unfair or unreasonable in the particular facts of the case. Before initiating legal proceedings, it is advisable to send a legal notice requesting a refund on compassionate and equitable grounds, enclosing your medical records.
If the institute still refuses, you may approach the Consumer Commission seeking an appropriate refund. While success cannot be guaranteed, your claim will be stronger if you withdrew before substantially availing the course and can establish that your inability to continue was due to a genuine medical condition supported by credible evidence.
