If your vehicle has repeatedly developed the same or similar defect despite repairs, and has remained in the service centre for a substantial period, you may have a case for deficiency in service and sale of a defective product under the Consumer Protection Act, 2019. Repeated repair attempts without permanently rectifying the defect may entitle you to seek a replacement vehicle or refund, depending on the facts and evidence.
You should preserve all job cards, repair invoices, service records, correspondence with the manufacturer and dealer, and any evidence showing the recurring defects. If the manufacturer refuses to replace the vehicle, you may issue a legal notice demanding replacement or other appropriate relief and, if necessary, file a complaint before the appropriate Consumer Commission seeking replacement, refund, compensation, and litigation costs.
