Ambiguity category and clarification
One more thing I thought to ask you about latent or patent ambiguity that if an agreement is such that the terms of the agreement are all clear and valid and one party is fully identified and regarding another party's identity is such that only the full name of the party is given like I, Suresh Kumar residing in Kolkata. Not the gender, age, PAN, Adhaar, parents or spouses details , address are given then is it patent or latent ambiguity arising from the document? And if instead of the full name only the first name is given with no any other identifiers then is it latent or patent ambiguity and in both cases an affidavit before enforcement after execution or witnesses testimony at the time of enforcement is sufficient to cure the defect?
