I am working in a well known nationalized bank. Our working hours are from 9:45 to 4:45PM. The manager is asking to work beyond 6PM. Even the lady employees are forced to work after the regulated working hours. If we refuse to work beyond 6PM our manager is acussing us of not doing the work properly and we re getting salary for being idle and we are not true to our organisation. We feel harassed fir rhis behaviour. Kindly suggest whether this comes under harrasment? What can we do for this problem ? What can be the legal action that we can take?

A.This is not harassment. unless it is beyond very late night, say after 10pm. He may be asking genuinely. Please check,
a) your bank will have rules / service matters book. check that.
b) Inform Regional Manager.

A.When you join a nationalized bank they ask you to sign lot of documents and one of them mentions that you are on the job for 24/7 and you can be called for the work at at any time. This is typically for the employee at the officer rank.
For the award staff (clerical level) the rules are different and they are supposed to work as per the agreement arrived at between the management and the staff union. For them the work stops exactly at the decided time every day. In case they are required to work beyond the working hours then they are paid overtime.

As I said for officers there are no rules and they can be asked to work for longer hours. Having said that a manger or branch manager cannot harass any one reporting to him/her in any manner. The times have changed and one cannot hide his bad behaviour. Certainly this will not amount to sexual harassment (POSH) but you all can send a formal representation to your seniors about his bad behaviour. Do not raise the POSH complaints unless he is saying or passing on any sexually coloured remarks.

A.Yes,
forcing an employee to work beyond his/her working hours comes under the definition of HARASSMENT.
you are advised to collect some evidence of your late exit from the bank premises for legal reference.
you can simply refuse or ask your manager to make a written request/order for staying/working in the bank beyond working hours.
also, intimate the behavior of your manager to the higher officials of the bank with a request to intervene in the matter and if remained unsolved, then sent the manager/bank a legal notice claiming compensation on account of mental stress, harassment, agony caused to you due to extra working time beyond stipulated hours.
