Dear client,
The Consumer Protection (Consumer Commission Procedure) Regulations, 2020 recognise representation through an authorised person, while also cautioning Consumer Commissions against unauthorised agents or persons making a profession of appearing as authorised agents.
Yes, one person may assist multiple consumers in filing their individual complaints online, but that does not mean that the same person automatically acquires authority to represent all those consumers before the Consumer Commission.
The Department of Consumer Affairs itself states that a consumer may file and represent the complaint personally or through a representative.
1.If the consumers will appear individually
2.If each complainant will personally appear before the Commission and conduct his/her own case, an authorisation letter is generally not required merely because someone helped with the e-Jagriti/e-filing process.
The position is different if the person who filed the complaints wants to appear, make submissions, sign pleadings, receive notices or otherwise act on behalf of the consumers. In that situation, proper authority should be placed on record. Filing hundreds of complaints should not be structured as though one person is the actual complainant for all the consumers. Each consumer's cause of action and claim should remain individually identifiable.
