Karnataka 2A NCL for married Woman
I need legal clarification regarding issuance of a Category 2A Caste and Income / Non-Creamy Layer certificate in Karnataka for a married woman for government recruitment. My wife belongs to Category 2A. She is currently not employed. Her parents are agriculturists and their income is below the prescribed limit. She is now residing with her husband after marriage. The concerned VA/RI/Tahsildar is refusing to consider her parents' income and is insisting that her husband's income must be considered, because the husband is a private employee and his income is above the prescribed income limit. They are relying on the Karnataka Government/Law Department opinion dated 19-01-2023, which refers to earlier DPAR Government Orders dated 19-09-1985 and 12-12-1986 concerning determination of income of married women. However, I understand that the 30-03-2002 New Comprehensive Creamy Layer Policy, as amended by the 2018 Government Order increasing the income limit to ₹8 lakh, refers to the candidate's father/mother/guardian in the relevant income provision. Further, in the 2025 Karnataka High Court Division Bench judgment in Shreya H.J., the Court considered the issue of a married Category-II(A) woman and interpreted the 2002 policy. The concerned officials are saying that the judgment applies only to that individual petitioner and therefore they will continue to consider the husband's income. My questions are: Under the currently applicable Karnataka rules/GOs, for a married Category 2A woman seeking an NCL certificate for government recruitment, whose income is legally required to be considered — her parents' income or her husband's income? Does the 19-01-2023 Law Department opinion based on the 1985/1986 DPAR GOs continue to govern the issuance of Category 2A NCL certificates after the 2002/2018 creamy-layer framework and the subsequent High Court judgments? Does the 2025 Division Bench judgment in Shreya H.J. have precedential value for similarly situated candidates, even though its operative direction was issued in favour of the individual petitioner? If the local Revenue authorities insist on considering the husband's income, what is the appropriate administrative appeal/revision remedy and competent authority? Is there any current Government Order/circular specifically directing Revenue authorities to consider the husband's income for a married woman's Category 2A NCL certificate? I am looking for the current legal position in Karnataka, preferably with the relevant Government Orders and judgments.
