Suit dismissed with cost

Every case is different and depends upon its own pleadings, documents, evidence, issues framed by the Court, and the reasoning recorded in the judgment. Therefore, the exact grounds for dismissal can only be understood after carefully reading the certified copy of the judgment and decree.

Generally, where a civil suit for declaration regarding a sale deed is dismissed with costs, the Court may have found that the plaintiff failed to establish the necessary legal grounds for the relief claimed. In a case such as the one described, an important issue may be whether the alleged non-payment of sale consideration, by itself, is sufficient to seek a declaration affecting or cancelling a registered sale deed. The Court may also examine whether the sale deed itself records receipt of the consideration amount, whether there is any documentary evidence regarding the promised cheques or unpaid amount, and whether the appropriate remedy should have been recovery of the unpaid sale consideration rather than a declaratory challenge to the registered deed.

The fact that the defendant allegedly did not file a written statement does not automatically mean that the plaintiff’s suit must be decreed. Even in the absence of a written statement, the plaintiff generally has to establish his or her own case through legally admissible evidence and prove entitlement to the relief claimed.

The immediate next step would generally be to apply for and obtain certified copies of the judgment and decree, along with examining the complete reasoning given by the Court. After consulting the judgment, the plaintiff may consider filing an appeal before the appropriate appellate court, if there are valid legal or factual grounds to challenge the dismissal. Depending upon the nature of the relief claimed, the findings of the trial court, the limitation period, and the facts of the transaction, other remedies may also need to be considered.
