PG Lease in a Gated community
Hello everyone, I am seeking views on whether a privately owned apartment building within a gated community in Chennai can be legally leased to a Paying Guest (PG) operator, and to what extent a residents' association can object to or restrict such use. Some relevant facts: The gated community consists of residential plots and apartment buildings. The internal roads and OSR (Open Space Reservation) areas have been gifted to the local Panchayat and are therefore public assets. The roads have openings at their ends that may potentially connect to adjoining plots or future developments if required. The apartment building is privately owned, and the owner proposes to lease the entire building to a PG operator. I understand that a recent Madras High Court ruling held that hostel/PG-type accommodation used for long-term residence can be treated as a form of residential use/residential dwelling in the context of the case before the Court. My questions are: Can a residents' welfare association or gated community legally prevent the owner from leasing the building to a PG operator? If PG accommodation is considered residential in nature, does that limit the grounds on which the association can object? Does the fact that the roads and OSR have already been handed over to the Panchayat affect the community's ability to restrict access to PG residents and their visitors? Are there any Chennai/Tamil Nadu regulations, CMDA rules, DTCP conditions, or local body approvals specifically applicable to PG operations within residential communities? Has anyone dealt with a similar issue, and what was the practical or legal outcome? I would appreciate insights from owners, residents, lawyers, or anyone familiar with apartment, planning, and local body regulations in Chennai. Thank you.
