my father and mother have a GR case(ipc 447,354,506,325) but i was not involve in this case.the case is totally false.now the other party want to include me in this case.my name was not in the charge sheet.the case is now in evience stage.can they include my name in this case?

A.Sir they can't include your name in the case and it is not the stage to add.

A.Dear Sir,
Yes, the prosecutor may file such application on the basis of available evidence. Such order if any passed you may challenge the same before High Court.

A.if your involvement is mentioned at the time of evidence, yes, you can be added by filing an application under section 319 CrPC

A.If court issues summon against you after an application under 319 CrPC you should immidately move high court under 482 CrPC for quashing the summons.

You should also on behalf of your father move an application for quashing of the FIR.

A.Section 319 of Cr. P.C. empowers the court to proceed against any person who is found to be an accused during any stage of the trail. This means that during the evidence stage it appears to the court that you are also a party in crime then court can start the trial against you as well. Ensure that when the Prosecution brings this up your lawyer is able to defend you properly and not allow the court to frame you.
