Wrong Document given and field FIR

One guy field a case( that not his surye number ) different surye number given in police station and field FIR (u/s section 41 A cr.pc 447,323 and 506) 1.
1.what can we do know...?
2.Police station notice dt 03/08/19 said to attend and not given timley (given in 09/09/19)
How can we move legally ? Can we send any notice to him

A.apply for getting the benefit of anticipatory bail,
