how to take position of land

Dear madam ....
we are three brothers ..total land is 76 acres
my elders brother is not supported to share property ..second brother was sold out his land according to passbook 26 acres..me also sold out 19 acres ,4 acres with me remaining 3 acres are located in other place in that 3 acres another X person in position...X person 3 acres are situated in our land who is in position is my elder brother...the land is not partitioned it is joint patta only...who can i take position of three acres
