We have outsourced a WEB application IT project to Ahmedabad base IT company with fix amount and fix time frame, current status is 30 to 40% work is completed of entire project  in total 10 month (complete project time frame is 2 month) we have given 80% advance payment, right now IT company is refusing to complete the entire project or even small tasks, IT company have clear understanding of consequence we certainly may face due to there refusal to complete the project. due to there refusal to complete remaining work with in time line our company is facing future existential crisis. what legal option we do have?

A.Dear Sir,
You can get issue a legal notice and threaten them to approach Court for compensation.

A.Hello.
Hope all is good.
However, I see a outsource agreement between your company and the other party. Now an agreement is a document which is binding. However, if they have agreed in the agreement that they will make it the stipulated time frame, they will have to. They cant deny. Also since you say that you have made 80% payment. They basic element of agreement i.e. consideration is complied with. Now the essence is that why are they denying. So here we have to look at this situation separately rather than intermingling with them. Here we need to take stand which allows them to pay back. So here they cant deny since there is an agreement to that effect. We shall need to send in a legal notice to that effect. But that sure they cant deny payback. Else you can initiate specific performance suit or recovery suit against them.
