Few graves have come up in my Land in the last decade or so , I have been a legal owner from more than three decades . The local slum people nearby my land would have dig and buried their near and dear ones in the land illegally and put up the graves . I am sure they will come for a fight when I go to clear them off as its my own private property . How can they do in someone else's property and what is the action that I can take to get back my land smoothly. I have a clear land title ,EC on my name till today. Please suggest

A.Go to the nearest police station and file complaint against them immediately. Or go to the court for injunction immediately

A.You should have taken care and they also should not have done that, what can you possibly do in such a situation, they are slum dwellers cannot compensate you, moreover, this cannot be compensated for, this is an irreparable injury to you, the issue needs examination, is there no graveyard nearby? If there is no such graveyard, then the state is responsible for it, file a writ in the High Court for appropriate directions in this regard. There can be a solution if you are willing for an exchange in a land. Otherwise, you cannot and should not disturb the peaceful possession of those graves.

A.Dear Sir,
You cannot remove and demolish such grave yards from your field though they have been put up illegally. You may file a civil suit and get a mandatory injunction and permanent injunction and accordingly put up a sign board in your land to avoid such happenings in future.

Thank you very much Sir for your reply . Will the debris / Graves be removed . Can I go for construction ? I hope I will not loose my land to the Graves . Wondering if I can go for construction or to sell it out but I might find buyers because of the Graves in it . Please suggest!!
