I have property on my name in which I am owner and my wife is co-owner. I have to remove my wife name from co-owner and I will be only owner. 1) I have done all payments and my wife is there for name only because I thought I will get some benefit in loan. But didnt/ 2) If I keep my wife as co-owner, will I be able to sell my flay without her sign as I am main owner. 3) If I have to remove her name as co-owner, whats process.

A.Dear Sir,
She has to execute relinquishment deed or Gift Deed in your favour in respect of her share to the extent of 50% in the property.

A.If you and your wife are joint owners of the property, you will need her signature mandatorily in case you want to sell the property. Without her signature you cannot or won't be able to sell the property.
This apart if you wish to remove her name as co-owner you will need to file a suit for declaration before the civil court and produce evidence therein to substantiate that payments were made entirely by you and hence her name must be deleted from the sale deed. It is a time consuming process. Your wife also has to be made a party. During the loan tenure, you cannot remove her name without the permission from the bank.

If u r joint property with out u r permission she can't sale
If u want to remove her name make a gift deed
