No Gate, No OC..can builder ask for maintenance? No Gate, No OC..can builder ask for maintenance?

I stay in an apartment near Sompura Gate, Sarjapur Road, Bangalore which has 4 blocks with 108 flats. There were 2 main gates promised/shown in the project plan/map but those are not yet open and blocked by the neighborhood society. OC too is not obtained yet. The gate which is being used by us now is a part of an under-construction apartment and most likely even that will be closed after few days. And we will be left with no entrance at all for our apartment.
Builder is showing minimal interest so far in this matter and now he has starred forcing us to pay monthly maintenance...can he do that?
Association is not yet formed either.

Any guidance/advice on the same would be highly appreciated.

A.Builder can't ask for maintenance. The agreement executed between you and builder has clause mentioned.
