Divorce on notary or on any deed is not a legal divorce until it's not done through court.

A.From the details it is not clear whether your marriage was under which form, that is, whether it is under Hindu rites and customs or it is under Special Marriage Act or under any other form. However, it appears that it is either under Hindu rites and customs. In Hindu Marriage Act a marriage can be dissolved by mutual consent by making a petition before the District Judge or in the case where there is no mutual consent then also one party has to file a petition for a divorce before the District Judge. In your matter it is not the case. So you are legally married couple and your marriage has not been dissolved. You may continue to live as couple. but as you have stated your wife has an affair with some one else and after making of the divorce deed under the guidance of a Lawyer how you and your wife were leading your life. Whether she was living with another person and in how. All these had to be seen. So you can take paid advice through Vidhikarya.
