I have given advance of 10 lakhs to purchase a house and after moving to bank got to know there is a problem in the Paper and it's not possible to get loan. The advance is given in the form of two checks to the owner and it is also mentioned in the agreement paper. We still have time of 23 days for the agreement paper to expire but the owner is not so cooperative to give us back the advance. How can we proceed further legally to get the money

A.Dear Sir,
Give instructions to your banker to stop the payment on the cheques if not encashed and then get issue a legal notice cancelling such agreement and claim for refund as this happened due to false representation by them about the title of the property.

A.Please read the agreement carefully, the clause will be there that if they will not sign the sale deed what will they do with the advance payment.
Also please send them a legal notice in order to make yourself legally safe.

A.You need to send a legal notice as soon as possible. Hope you have all the cheque details and photocopies.

A.If title papers are defective you can send them legal Notice and demand advance back and deny liability from such agreement. For further detailed discussion plz contact through Vidhikarya
