re. our ongoing pratapniwas at opp. Kalidas mulund west redevlopment project... need to discuss...

Dispute as under

Developer is working on his sale part of commrcl. And residential part according to update on site and on rera web site update


He has left paying regular rent payment to all 45 tenants since last 2 year at present more then 15 month rent incl.. some of brokerage... Due balance not paid by developer


Committed date of handour to old tenant is passed out more then 1.5year back (which including grace period of 6month) according to register agreement with each 45 old tenant



According rera web site he mentioned date of hendour/completion of project @dec. 2020. Which is 3year later then mentioned in register agreement with each 45 old tenant

Possession given to commercial part few shop and hotel is running now since more then 1.5year. Which is wrong as according to register agreement with each 45 old tenant 1st of all tenant will get possession and then any other sale part possession allowed

according to register agreement with each 45 old tenant -Developers shall be liable to pay to the Tenants compensation of Rs.1000/- per day from period, if there is a delay beyond 30 months from the date of IOD to which the Owners/Landlords/Developers agreed to pay to the Tenant/Occupant herein. Which is more then 500days our and done but he has not paid any amount towards this to any tenant


according to register agreement with each 45 old tenant -during the process of redevelopment any extra FSI benefit announcement by development authority and if it utilised then that benefit will be on sharing basis componsat sharing to old tenants equally (50/50) developer/tenant that too is done by developer as initially plan of ground floor commercial + 1 podium parking and 1 stilt parking on 2nd floor but due to recent announcement by development authority he sold 1st floor podium around 10000 sqft to hospital and made parking tower without tenants concent or official any intimation

And few more....


So looking at developers other similar project in Muslims east and west few are incomplete more then 17year and 10year respectively all we 45 Tennant find we need to take action on developer and bring stay on sale and commercial part on going work aswel as use of partially commercial already given on lease or sold property in same project to bring attention and complete tenant part pending work and hendour of agreed new residential premises to tenant at earliest and also regularis pending and future rent and due penalty etc... Officially
