Land partition case
Sir my ancestors (grandfather) had trifurcated their residential land among their three brother way back in 1970s. All matter related to land partition is there on a simple paper bearing signature of trio party along with witnesses. Now 40 yrs down the line one party says that they are at disadvantageous position in this partition hence they want new partition. In light of this some questions are :
Q. 1. Does this simple piece of paper bearing sign of trio party and that of witnesses has any sanctity in the eyes of law? If, yes, then to what extent?
Q. 2. Is there any provision by which we are necessitated to maintain status quo? If, any, what are they?
Q. 3. Party that want partition to be done afresh is saying that land in their possession is disputed one as their were temple at this land in past. However this land was bought by my ancestors and we have valid document substantiating the same. In this regard question is -
Having considered that there was a temple and it was sold to my ancestors, to what extent, legally, this fear of land being claimed by any other people/government is justified ?
Note :there is not any claimant yet and one party has raised this issue only as a reason to not respect earlier partition.
