I am the President of a housing association in Kochi comprising of 24 plots. It's a gated compound and houses have been constructed in 20 plots. Four of the plots are still vacant and owners of the plots are not planning to construct a house in the plot in the near future. While selling the plots, the builder did not specify any time limit for construction of house. Keeping the plots vacant is a safety and security hazard for other residents of the compound. Further construction of the house at a later date will have serious impact on security, safety and environmental issues to the residents. The vacant plot owners are also registered members of the housing association and as such they should be bound by decisions of the general body.
Now my question is whether the general body can fix a time limit for construction of a house in the plot or not from legal point of view.

A.Dear Sir,
Yes, you can pass necessary resolution calling upon the builder to complete the work within specified time frame and if failed initiate civil action by approaching Civil Court or High Court.

A.Any decision taken in the AGM or special meeting and attended and/or supported by majority members is binding.
