Case under 13 B mutual consent was registeres on 18th oct 2014 but after six month time husband not appeared in court as he has change his mind. Now its been 5 years so is there any law for legally separation without husband permission except from One sided divorce filing.

You may file an amendment application to convert into a case under Section 13 (1) (ib) of Hindu Marriage Act or directly file another case.

A.You can proceed with desertion application before the court. But for getting order you must be leaving apart from your husband as per the definition provided under desertion as a ground.

A.Pls provide details, e.g facts which happened in 5 years time, to advice you better. You may contact your husband to speak of divorce by mutual consent or you will have to file a one sided divorce petition.
