whether a statement of admission in 251 cr.p.c examination in a 138 ni act case is ground for conviction? he said in examination only a single statement for a question as "ill return the money", is he gonna be convicted? is delay in filing complaint without any delay petition is fatal to case without considering any material

A.Dear Sir,
Without seeing entire history of the case no concrete legal opinion can given. Normally when accused admits the Magistrate as to record the same and proceed to pronounce judgment without any delay and try to ask your advocate to convince the judge to get judgment of conviction on such admission.

A.Delay if any is required to be condoned by the Court and for that u have to file separate delay condonation application. Statement us 251 shouldn't b valid and complete ground. If you want to pay and are able to pay the matter would b compounded with consent of the Complainant and hence you should be acquitted.
